1. Introduction
Welcome to Claim Save. These Terms and Conditions ("Terms") govern your access to and use of the Claim Save platform, website, and related services (collectively, the "Services"). By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
Claim Save is a web-based claims management platform that enables users to load, submit, track, and manage insurance claims through an online form system. The platform is operated by Claim Save (Pty) Ltd, a company registered in the Republic of South Africa.
If you do not agree with any part of these Terms, you must not access or use the Services.
2. Definitions
In these Terms, unless the context indicates otherwise:
- "Claim Save," "we," "us," or "our" refers to Claim Save (Pty) Ltd, the owner and operator of the platform.
- "User," "you," or "your" refers to any individual or entity that accesses or uses the Services, including but not limited to policyholders, brokers, insurers, administrators, and employees.
- "Platform" refers to the Claim Save web application, including all features, tools, forms, dashboards, and related systems.
- "Services" refers to all services provided through the Platform, including claims submission, document management, tracking, reporting, and communication tools.
- "Account" refers to the registered user profile created to access the Services.
- "Content" refers to any data, text, files, documents, images, or other materials uploaded, submitted, or transmitted through the Platform.
- "Personal Information" has the meaning ascribed to it under the Protection of Personal Information Act, 2013 (POPIA).
3. Use of Services
3.1 Eligibility
You must be at least 18 years of age and have the legal capacity to enter into a binding agreement to use the Services. If you are using the Services on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms.
3.2 Account Registration
Access to the Platform requires a registered Account. Accounts are created and issued by Claim Save or an authorised administrator within your organisation. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your Account.
3.3 Permitted Use
You may use the Services only for their intended purpose — the submission, management, and tracking of insurance claims. You agree not to:
- Use the Services for any unlawful, fraudulent, or malicious purpose;
- Attempt to gain unauthorised access to any part of the Platform or its underlying systems;
- Interfere with or disrupt the integrity or performance of the Services;
- Reverse-engineer, decompile, or disassemble any part of the Platform;
- Upload or transmit any content that contains viruses, malware, or other harmful code;
- Use the Platform to transmit unsolicited communications or spam;
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
3.4 Service Availability
We strive to maintain high availability of the Platform but do not guarantee uninterrupted, error-free, or secure access. The Services may be temporarily unavailable due to scheduled maintenance, updates, or circumstances beyond our reasonable control.
4. User Responsibilities
As a user of Claim Save, you agree to:
- Provide accurate, complete, and truthful information when submitting claims, forms, or any other data through the Platform;
- Keep your Account credentials secure and notify us immediately of any suspected unauthorised use;
- Comply with all applicable laws and regulations, including but not limited to the laws of the Republic of South Africa;
- Ensure that any Content you upload does not infringe the intellectual property rights or privacy rights of any third party;
- Use the Platform in a manner that is respectful and does not cause harm to other users, Claim Save, or its partners;
- Promptly update any information that becomes inaccurate or outdated.
You acknowledge that Claim Save is a claims management tool and does not provide legal, financial, or insurance advice. Any decisions made based on information obtained through the Platform are your sole responsibility.
5. Fees and Payments
5.1 Subscription and Service Fees
Certain features or tiers of the Services may be subject to subscription fees or usage-based charges. Where applicable, fees will be clearly communicated to you prior to activation, and you agree to pay all fees associated with your selected plan.
5.2 Payment Terms
Fees are invoiced in South African Rand (ZAR) unless otherwise agreed in writing. Payment is due within the period specified on your invoice. Late payments may result in the suspension or termination of your access to the Services.
5.3 Changes to Fees
Claim Save reserves the right to modify its fee structure at any time. Any changes will be communicated to affected users with at least 30 days' prior written notice. Continued use of the Services after the effective date of a fee change constitutes acceptance of the revised fees.
5.4 Refunds
Fees paid are generally non-refundable unless otherwise specified in a written agreement between you and Claim Save, or as required by applicable law.
6. Limitation of Liability
6.1 No Warranties
The Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory. Claim Save does not warrant that the Services will be uninterrupted, timely, secure, or error-free, nor does it make any warranty as to the accuracy, reliability, or completeness of any information obtained through the Platform.
6.2 Limitation of Damages
To the maximum extent permitted by applicable law, Claim Save, its directors, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of the Services.
6.3 Maximum Liability
In no event shall Claim Save's total aggregate liability to you for all claims arising out of or relating to the use of the Services exceed the total amount of fees paid by you to Claim Save during the twelve (12) months immediately preceding the event giving rise to the claim.
6.4 Third-Party Services
The Platform may integrate with or contain links to third-party services, including insurance providers, payment processors, and mapping services. Claim Save is not responsible for the availability, accuracy, or practices of any third-party service, and your use of such services is at your own risk.
7. Intellectual Property
7.1 Ownership
All intellectual property rights in and to the Platform, including but not limited to the software, design, logos, trademarks, text, graphics, and underlying technology, are and shall remain the exclusive property of Claim Save or its licensors.
7.2 Limited Licence
Subject to your compliance with these Terms, Claim Save grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for its intended purpose. This licence does not include the right to copy, modify, distribute, sell, or lease any part of the Platform or its content.
7.3 User Content
You retain ownership of any Content you submit through the Platform. By uploading Content, you grant Claim Save a non-exclusive, worldwide, royalty-free licence to use, store, process, and display such Content solely for the purpose of providing the Services to you. Claim Save will not sell or share your Content with third parties except as required to deliver the Services or as required by law.
8. Privacy and POPIA Compliance
8.1 Data Protection
Claim Save is committed to protecting your Personal Information in accordance with the Protection of Personal Information Act, 2013 (POPIA) and other applicable data protection legislation in South Africa.
8.2 Collection and Processing
We collect and process Personal Information that is necessary for the provision of the Services, including but not limited to contact details, identification documents, claim-related information, and usage data. Personal Information is processed lawfully, for a specific purpose, and only to the extent necessary.
8.3 Your Rights
Under POPIA, you have the right to:
- Access your Personal Information held by Claim Save;
- Request the correction or deletion of inaccurate or outdated Personal Information;
- Object to the processing of your Personal Information in certain circumstances;
- Lodge a complaint with the Information Regulator if you believe your rights have been infringed.
8.4 Data Security
We implement appropriate technical and organisational measures to safeguard your Personal Information against unauthorised access, loss, destruction, or damage. These measures include encryption, access controls, and regular security assessments.
8.5 Data Sharing
We may share your Personal Information with third parties only where necessary to provide the Services (e.g., insurance providers, hosting services), where required by law, or where you have provided explicit consent. We do not sell your Personal Information.

9. Termination of Service
9.1 Termination by You
You may request the termination of your Account at any time by contacting Claim Save at admin@claimsave.co.za. Upon termination, your access to the Services will be revoked, and your data will be handled in accordance with our data retention policies and applicable law.
9.2 Termination by Claim Save
Claim Save reserves the right to suspend or terminate your access to the Services, without prior notice, if:
- You breach any provision of these Terms;
- Your use of the Services poses a security risk or may cause harm to other users or to Claim Save;
- Your Account has been inactive for an extended period;
- We are required to do so by law or regulatory authority;
- We discontinue the Services or any part thereof.
9.3 Effect of Termination
Upon termination, all rights and licences granted to you under these Terms will immediately cease. Provisions of these Terms that by their nature should survive termination — including, without limitation, provisions relating to intellectual property, limitation of liability, and governing law — shall continue to apply.
10. Governing Law
10.1 Applicable Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions.
10.2 Jurisdiction
Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.
10.3 Dispute Resolution
In the event of a dispute, the parties agree to first attempt to resolve the matter through good-faith negotiation. If the dispute cannot be resolved within thirty (30) days of written notification, either party may submit the matter to mediation before pursuing formal legal proceedings.
10.4 Amendments
Claim Save reserves the right to amend these Terms at any time. Material changes will be communicated to users via the Platform or by email. Your continued use of the Services following the publication of amended Terms constitutes your acceptance of those changes.
10.5 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
10.6 Entire Agreement
These Terms, together with any applicable service agreements and our Privacy Policy, constitute the entire agreement between you and Claim Save with respect to the use of the Services, and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.
